These Terms of Service (“Terms”) govern your access to and use of Maximailist (“we,” “our,” or “us”), the email marketing platform available at maximailist.com. By creating an account or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the platform.
You must be at least 18 years old to use Maximailist. By using the platform, you represent that you are 18 or older.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You may not create multiple accounts to circumvent plan limits, avoid bans, or abuse promotional offers.
You must notify us immediately at [email protected] if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.
Maximailist is an email marketing platform designed for real estate agents, brokers, and related professionals to send permission-based marketing emails to their contacts.
You may use Maximailist to send: property listing emails, market reports, newsletters, open house invitations, client follow-up sequences, and other legitimate real estate marketing communications.
You must have obtained proper consent from all email recipients before adding them to your contact lists or sending them any campaign. You are solely responsible for maintaining records of consent.
You may not use Maximailist to send unsolicited commercial email (spam). All campaigns must be sent to contacts who have expressly consented to receive email communications from you.
You may not send emails containing: illegal content, malware, phishing, deceptive content, hate speech, harassment, adult content, or content that promotes violence or illegal activities.
You may not upload or send to purchased, rented, scraped, or harvested email lists. All contacts must have a direct, pre-existing relationship with you.
You may not impersonate another person or entity, or falsely represent your affiliation with any person or entity in your email campaigns.
You may not attempt to: reverse-engineer the platform, access other users' data, circumvent usage limits, overload our servers, or interfere with platform operations.
You may not resell, sublicense, or provide access to the platform to third parties without our express written consent.
You are solely responsible for ensuring all email campaigns comply with applicable anti-spam laws, including: CAN-SPAM Act (United States), CASL — Canadian Anti-Spam Legislation (Canada), and GDPR (European Union/UK). We do not provide legal advice; consult a qualified attorney for compliance guidance.
All campaigns sent through Maximailist must include: a valid physical mailing address, a clear identification of the sender, and a working unsubscribe mechanism. Maximailist automatically includes an unsubscribe link in all campaigns.
You must honor all unsubscribe requests. Maximailist processes unsubscribes automatically. You may not re-add unsubscribed contacts or attempt to circumvent unsubscribe requests.
We automatically suppress hard-bounced addresses and addresses that report spam. You agree to maintain a bounce rate below 5% and a complaint rate below 0.1%. Exceeding these thresholds may result in account suspension.
Maximailist offers Free, Starter, Pro, and Enterprise subscription plans. Plan details and pricing are available at maximailist.com/pricing. We reserve the right to modify pricing with 30 days' notice.
Paid plans are billed monthly or annually (at a 20% discount) in advance. Payment is processed securely through Stripe. You authorize us to charge your payment method for all fees incurred.
The free plan is provided without charge and includes limited features. We reserve the right to modify or discontinue the free plan with 30 days' notice.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for unused time on paid plans.
If you exceed your plan's email sending limit in a billing period, we will notify you. We will not silently drop emails — we will contact you to upgrade or wait until the next billing cycle.
Maximailist and all its content, features, and functionality (including but not limited to software, text, displays, images, and design) are owned by us and are protected by intellectual property laws.
You retain ownership of all content you create and upload to Maximailist (email content, contact data, campaign assets). You grant us a limited license to store, process, and transmit your content solely for the purpose of providing the platform services.
If you provide feedback, suggestions, or ideas about the platform, you grant us an irrevocable, royalty-free license to use that feedback for any purpose.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAXIMAILIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Maximailist and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: your use of the platform, your violation of these Terms, your violation of any law or regulation, or your email campaigns and their content.
You may close your account at any time from your account settings or by contacting [email protected].
We may suspend or terminate your account immediately, without notice, if: you violate these Terms, your campaigns generate excessive bounces or complaints, you engage in prohibited activities, or we are required to do so by law.
Upon termination, your right to use the platform ceases immediately. We may retain your data for up to 90 days after termination for backup purposes, after which it will be deleted.
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
We may modify these Terms at any time. We will provide at least 30 days' notice of material changes by email and by posting the updated Terms on this page. Your continued use of the platform after the effective date of changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the platform.
